How long do you have to report a workplace injury in South Carolina if you’re injured on the job? How do you report a workplace injury and file a workers’ compensation claim?

If you’ve sustained an injury on the job in South Carolina or have developed an illness due to workplace conditions, you need to report it in a timely manner or risk losing out on benefits.

Here’s what you need to know about how to report a workplace injury or illness in South Carolina and how long you have to do so.

90 Days to Report a Workplace Injury or Illness in South Carolina and Two Years to Claim

You have 90 days to report an injury or illness to your employer. You must report it within this time or risk being barred from receiving benefits. Report to your manager, supervisor, HR, or someone in a similar role.

You also have two years to make a claim related to your workplace injury or occupational illness. You do not have two years to report an injury or illness to your employer. This two-year limit is the time frame you have to make a claim, not the time you have to report your injury.

Reporting Requirements: How to Report a Workplace Injury in South Carolina and File a Claim

As the injured or ill worker, your only responsibility is to report your injury or illness to your employer within 90 days. From there, your employer will file a claim with the South Carolina Workers’ Compensation Commission to get the process started.

The only time you would need to file a claim yourself is if your employer failed to file a claim for you. In that situation, it’s smart to call a workers’ compensation lawyer for help and advice on what to do next.
