Determining Liability in Pedestrian vs. Vehicle Collisions

In pedestrian-vehicle accidents, it’s the driver who’s at fault, right? Not necessarily. A recently published examination of over 2,700 pedestrian crashes in Ohio found that drivers were found at fault 53.6% of the time and pedestrians at fault in 36.4% – more than 1 in 3 accidents.

What does this mean for you? If you’re involved in a pedestrian-vehicle accident in South Carolina, a crucial step to coming to a settlement is determining liability, that is, finding out who was at fault for the accident. It may be the driver, the pedestrian, or both.

When determining liability in a pedestrian accident in South Carolina, here are some factors to consider.

Catastrophic Injuries: Seeking Maximum Compensation for Spinal Cord Damage

Damage to the spinal cord can lead to catastrophic injuries resulting in loss of function, loss of sensation, and chronic pain that can last a lifetime.

If you’ve sustained spinal cord injuries due to the actions or negligence of another party, you may be able to bring a personal injury claim for compensation. However, getting maximum compensation after a spinal cord injury can be challenging. Here’s what to know.

(Note: If you suffered a spinal cord injury while at work and you’re covered under workers’ comp in South Carolina, you will likely make a workers’ compensation claim instead. Read more about that here on our blog.)

Common Injuries in Truck Accidents and Pursuing Compensation

As we’ve previously covered on this blog, traffic accidents involving tractor-trailers and other large trucks are different from accidents involving only passenger cars. They are often more devastating and destructive, leading to disproportionately more fatalities and severe injuries for occupants of passenger cars. Certain types of injuries are common in large truck accidents, which we cover below.

If you’ve been injured through no fault of your own in an accident with a large truck (aka big rig, semi-truck, tractor-trailer, or 18-wheeler), you may also be able to pursue compensation from the at-fault party or parties. Read on to find out how.

What Happens When a Truck Driver Has an Accident?

When a commercial truck driver is involved in a traffic accident, what happens next is in some ways the same, and some ways different, from when a driver of a passenger car is involved in an accident. That’s because the holder of a commercial driver’s license (CDL) is subject to additional state and federal laws and often additional employer regulations, too.

Here’s what happens after a large truck driver has an accident, and what it means for you.

What Is The Most Common Type Of Workplace Injury

Workplace injuries are, unfortunately, not rare. Private industry employers reported 2.3 million nonfatal injuries in 2022, according to the Employer-Reported Workplace Injuries and Illnesses, 2021-2022 news release released on November 8 by the BLS.

Nonfatal workplace injuries can lead to days away from work, lost productivity, lost wages, medical bills, and even permanent disfigurement and disability. However, the majority of workplace injuries are not permanently life-altering, including the most common type of workplace injury.

What Is a Pedestrian Safety Zone?

A pedestrian safety zone is a designated area on or by a roadway that focuses on pedestrian safety. They’re typically found in areas with high foot traffic such as tourist locations, shopping areas, and school zones, or in areas that see a disproportionately high number of pedestrian accidents. The purpose is to reduce injuries and fatalities from pedestrian accidents.

Pedestrian safety is of special interest to us, since South Carolina was found to be #13 among states with the most pedestrian fatalities 2010-2019, according to a 2021 study by Smart Growth America using data from the NHTSA. Particularly bad, Greenville-Anderson-Maudlin, SC made the list of the top 20 most dangerous areas in the nation for pedestrians, coming in at number 14.

Experts agree that the majority of pedestrian deaths are preventable, as are most pedestrian injuries, and one way to reduce pedestrian accidents is to implement pedestrian safety zones.

How Many Semi-Truck Accidents Occur Per Year?

Approximately 200,000 semi-trucks (aka tractor-trailers or 18-wheelers) are involved in accidents on U.S. roads every year, according to the National Highway Traffic Safety Administration (NHTSA). But what’s behind the numbers? How deadly are semi-truck accidents?

The statistics below look at data for the year 2020 (the most recent year for which these stats are available) and can be found in the NHTSA’s Traffic Safety Facts Annual Report; find the tables referenced below here. The Insurance Institute for Highway Safety, or IIHS, also has a good, more readable overview of the NHTSA data here
